WARRANTY

Unless otherwise stated in our Proposal the following applies:

Machinery: PACIFICA TUBE BENDER TOOLING, INC . warrants to the present

purchaser that equipment, components and systems on machines remanufactured by

PACIFICA TUBE BENDER TOOLING, INC . will be warranted for one year from date of

receipt/delivery of machine. Seller will accept within thirty days from shipment any

remanufactured machinery sold with a return privilege, freight prepaid by purchaser, for

refund of the purchase price if proven mechanically unsatisfactory, or repair at Pacifica

Tube Bender Tooling, Inc.'s option.

The obligation of PACIFICA TUBE BENDER TOOLING, Inc . under this warranty shall be

exclusively limited to the repair or replacement, at its sole option, of parts that are

determined by PACIFICA TUBE BENDER TOOLING, Inc . to have failed because of defective

workmanship. On simple warranty replacements or repairs, PTBT will provide

installation instructions to allow correction by customer personnel. This warranty does

not cover items that would normally be consumed or require replacement due to normal

wear (filters, lubricants, friction surfaces, etc.) or parts damaged due to accident or

misuse.

Buyer in purchasing equipment agrees upon receipt of machinery subject to this

agreement. It will be buyer's duty to inspect all machinery on a continuing basis, provide

proper safety devices and equipment or means necessary to safeguard each machine to

meet all government safety standards which may be imposed from time to time,

including, but not limited to: 1970 Occupational Safety and Health Act.
